Terms of Service

1. Acceptance of Terms

By downloading or using the All Kards mobile application ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

All Kards is a digital organization tool for non-payment cards, including loyalty cards, library cards, gym memberships, insurance cards, transit passes, business cards, and similar items. The Service allows you to photograph, store, and organize these cards locally on your device.

Important: All Kards must NOT be used to store credit cards, debit cards, or any payment card information. The app is not designed or certified for payment card storage. You may store ID cards (such as student IDs or employee badges) for personal reference only — the app is not a substitute for official identification documents.

3. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the All Kards application on a device that you own or control, for your personal, non-commercial use.

4. Local-Only Nature & Data

• Local Storage: You acknowledge that All Kards stores all data locally on your device. We do not operate cloud servers and have no access to your stored cards.
• Backup & Restore: The app includes a backup feature that creates a file on your device. You are responsible for saving this file to a safe location. We are not responsible for lost backup files or failed restorations.
• Data Loss: If you lose your device, damage it, clear app data, or uninstall the app without creating a backup, your saved cards will be permanently lost. We are not responsible for any such loss of data.

5. User Conduct & Legal Compliance

You agree to use the app only for lawful purposes. You are prohibited from:

• Reverse engineering, decompiling, or attempting to extract the source code of the app.
• Using the app to store illegal, fraudulent, or infringing content.
• Storing credit cards, debit cards, or payment card information.
• Distributing, sublicensing, or reselling the app or any portion of it.
• Using the app in any way that violates applicable local, state, national, or international law.

6. Intellectual Property

The All Kards name, logo, and software are the exclusive property of All Kards (allkards.com) and are protected by copyright and intellectual property laws. All rights not expressly granted in these Terms are reserved.

You retain ownership of any card images and content you add to the app. We claim no rights over your personal content.

7. Updates and Modifications

We may release updates to the app from time to time, which may include bug fixes, new features, or changes to existing functionality. While we strive to maintain backward compatibility, we cannot guarantee that all features will remain unchanged across updates. You are responsible for keeping the app updated to the latest version.

8. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the app will be error-free, uninterrupted, or that it will meet your specific requirements. Card images stored in the app are not a replacement for physical cards and may not be accepted by all establishments.

9. Limitation of Liability

To the maximum extent permitted by law, All Kards and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the app, including but not limited to:

• Loss of data due to device failure, app uninstallation, or failure to create backups.
• Inability to present a card at a point of service.
• Unauthorized access to your device or app data.
• Any errors or inaccuracies in the app's functionality.

10. Indemnification

You agree to indemnify and hold harmless All Kards, its developers, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the app or your violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the app shall be subject to the exclusive jurisdiction of the courts in Canada.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website and reflected in the app. Your continued use of the app after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
